Foreign Worker Re-contracting Procedure
If you wish to re-contract with a foreign worker, you must follow the procedures below.
1. Extension Application at the Employment Center
Application Timing: You must apply for an extension at the Employment Center before the contract expiration date.
Documents to Submit: Submit the "Foreign Worker Employment Permit Extension Application" with the renewed employment contract attached.
2. Review and Approval by the Employment Center
The Employment Center reviews the application and decides whether to grant the extension.
During the review, it comprehensively considers the employer's intention to maintain employment, the foreign worker's work performance, and other factors.
3. Foreign Registration (Change) Application
Once the employment permit is extended, the foreign worker must apply for foreign registration (change) at the Immigration Office.
4. Conclusion of New Employment Contract
Once the employment permit extension is confirmed, the employer and the foreign worker must conclude a new employment contract.
5. Precautions for Re-contracting
Changes in Working Conditions: If changing working conditions such as wages or working hours, you must fully consult with the foreign worker.
Prevention of Illegal Employment: Do not employ foreign workers through illegal methods or treat them unfairly.
Re-employment: For foreign workers with contracts of 1 month or longer, re-employment applications can be made from 90 days before to 7 days before the job-seeking activity period expiration date. If re-employed, the foreign worker's employment period is extended by 1 year and 10 months.
