How are the procedures conducted after filing an objection?
▪ The local immigration and foreigner office that receives the objection checks if the objection form is fully completed and issues a receipt for the objection to the applicant.
▪ Once the objection is received, a refugee investigator from the Ministry of Justice conducts a factual investigation regarding the objection, followed by deliberation by the Refugee Committee, and then the Minister of Justice decides on refugee recognition.
▪ The Minister of Justice respects the deliberation results of the Refugee Committee within the scope deemed not to harm national security, maintenance of order, or public welfare, and makes a decision on the objection. (Article 11, Paragraph 2 of the Enforcement Decree of the Refugee Act)
▪ When the Minister of Justice makes a decision on the objection, the result is notified to the local immigration and foreigner office, and the office delivers a refugee recognition certificate or a rejection/dismissal decision notice for the objection to the applicant or their representative. The local immigration and foreigner office requires the applicant or their representative to appear in person to receive the refugee recognition certificate or the rejection/dismissal decision notice via mobile phone text message, phone, or mail.
▪ The decision on the objection typically takes 6 months to 1 year from the date of filing the objection, and in 2020, it took an average of about 10.7 months.
