Refugee Recognition Examination Criteria
The refugee recognition examination is a very important procedure that determines whether the refugee applicant is actually at risk of persecution in their home country. The examination criteria are based on the International Refugee Convention and each country's domestic laws, and generally comprehensively consider the following elements.
1. Risk of Persecution
It verifies whether there is sufficient grounds for persecution due to race, religion, nationality, membership in a particular social group, or political opinion.
Severity of Persecution: It comprehensively considers various forms of persecution, such as physical and mental suffering, deprivation of liberty, threats to life, etc.
Perpetrator of Persecution: It reviews the possibility of persecution by various entities, such as government, non-governmental armed groups, civilians, etc.
2. Inability of Protection by the Country of Nationality
It determines whether the applicant cannot receive safe protection to avoid persecution if they return to their country of nationality.
Human Rights Situation in the Country of Nationality: It comprehensively considers the human rights situation, legal system, social instability, etc., in the applicant's country of origin.
3. Principle of Individuality
Each refugee application is judged as an individual case, comprehensively considering the applicant's characteristics, experiences, evidence, etc.
General Situation: In addition to the general situation in the country of origin, it also considers the special circumstances faced by the individual applicant.
4. Evidence
It reviews the credibility of the evidence materials submitted by the applicant.
Types of Evidence: It comprehensively reviews various evidences such as passports, identity cards, medical records, press reports, witness statements, etc.
5. Credibility
It determines whether the applicant's statements are consistent and reliable.
Credibility of Statements: It reviews whether the applicant's statements match the submitted evidence, do not contradict other testimonies, etc.
