Guidance on the Obligation to Submit Tuberculosis Diagnosis Certificate for Foreigners
▣ Target Individuals Required to Submit Tuberculosis Diagnosis Certificate
◯ When Applying for a Visa
- Cases where a visa is applied for with the purpose of staying in Korea for more than 90 days* (for electronic visa holders, submit at the time of foreign resident registration after entering Korea)
* Refers to Article 10-2, Paragraph 1, Item 2 (long-term stay qualification) of the Immigration Act (even if the stay period is 90 days or less, submission is required if applying for a long-term stay qualification visa)
- Among short-term stay qualifications, seasonal workers (C-4-1 to 4) and cases where a foreign tuberculosis patient residing in Korea invites family members, etc., as caregivers
- Cases where a new long-term stay visa is to be issued after submitting a tuberculosis diagnosis certificate in the past, staying long-term in Korea, and then completely departing
◯ When Registering as a Foreign Resident
- Cases where foreigners required to submit a tuberculosis diagnosis certificate at visa application enter Korea with an electronic visa
- Cases where nationals of high-risk tuberculosis countries hold a multiple-entry visa allowing long-term stay and enter Korea more than 6 months after the visa issuance date
◯ When Applying for Permission to Stay
- Cases where nationals of high-risk tuberculosis countries who entered with short-term stay qualification apply to change to long-term stay qualification
- Among nationals of high-risk tuberculosis countries staying with long-term stay qualification, those who have not submitted a tuberculosis diagnosis certificate for visa and stay permission applications after March 2, 2016
- For registered foreigners of high-risk tuberculosis countries applying for extension of stay period or change of stay qualification, cases where they have stayed long-term for 6 months or more continuously in a high-risk tuberculosis country within 1 year prior to the application date
※ Not required if the destination country of departure is not a high-risk tuberculosis country
(If confirmation of the departure destination is not possible, submission of the tuberculosis diagnosis certificate is the principle, but exemption is possible if the individual proves they did not visit a high-risk tuberculosis country)
◯ Exclusions from Application
- Holders of diplomatic (A-1), official (A-2), or treaty (A-3) qualifications
- Children under 6 years of age (submit at the first stay permission application after turning 6) and pregnant women
- Persons unable to move due to advanced age or illness
▣ High-Risk Tuberculosis Countries (35 countries)
• Nepal, East Timor, Russia, Malaysia, Mongolia, Myanmar, Bangladesh, Vietnam, Thailand, Sri Lanka, Uzbekistan, India, Indonesia, China, Cambodia, Kyrgyzstan, Pakistan, Philippines, Laos, Kazakhstan, Tajikistan, Ukraine, Azerbaijan, Belarus, Republic of Moldova, Nigeria, Republic of South Africa, Ethiopia, Kenya, Democratic Republic of the Congo, Mozambique, Zimbabwe, Angola, Peru, Papua New Guinea
