What is Regular Wage?
1. Generally, regardless of names such as base salary or fixed salary mentioned by the company, it refers to the hourly, daily, weekly, monthly, or piece-rate wage amount that is regularly and uniformly paid to workers for their prescribed working hours or total working hours. In other words, it is the general wage that is fixed and paid on average each payday, without being bound by the actual number of working days or the actual wages received. Fixed base salary or fixed salary that is guaranteed to be paid regularly, uniformly, and monthly on average, as well as job allowance, position allowance, adjustment allowance, cost-of-living allowance, cashier allowance, crew allowance, etc., are included in regular wage.
However, overtime allowance, monthly paid leave allowance, annual leave allowance, and bonuses that vary depending on individual working hours are not included in regular wage. Regular wage serves as the basis for calculating statutory allowances such as overtime pay, and allowances for annual and monthly leaves.
2. Regular wage is a special wage among the 'monthly salary' we commonly refer to, which serves as the standard for calculating various allowances. In simple terms, it determines how much extra you can receive for working overtime or on holidays, or what amount to use as the basis for calculating severance pay—it's an important factor.
Why is Regular Wage Important?
Basis for calculating various allowances: Various allowances such as overtime pay, holiday work pay, and night work pay are calculated based on regular wage.
Basis for severance pay calculation: Severance pay is also calculated based on regular wage, so the higher the regular wage, the more severance pay you receive.
Protection of workers' rights: Accurate understanding of regular wage plays an important role in helping workers properly assert and protect their rights.
What is Included and Not Included in Regular Wage
Included: Base salary, job allowance, position allowance, regular bonuses, etc., which are wages paid regularly and uniformly
Not included: Overtime pay, holiday work pay, various allowances, bonuses (excluding regular bonuses), etc.
Why Distinguish Regular Wage Separately?
Defined in Labor Standards Act: It is because the Labor Standards Act clearly defines regular wage.
Convenience in calculating various allowances: Calculating various allowances based on regular wage makes the process simple and fair.
Protection of workers' rights: Clearly defining regular wage protects workers' rights and prevents disputes between labor and management.
