What is the Minimum Wage Act?

This Act aims to contribute to the sound development of the national economy by guaranteeing the minimum level of wages for workers, thereby ensuring their living stability and improving the quality of the labor force. The minimum wage amount (meaning the amount set as the minimum wage, hereinafter the same) is determined on an hourly, daily, weekly, or monthly basis. In this case, when determining the minimum wage amount on a daily, weekly, or monthly basis, it must also be indicated as an hourly wage. According to the effect of the minimum wage, employers must pay wages of at least the minimum wage amount to workers subject to the minimum wage, and must not reduce the previous wage level on the grounds of the minimum wage under this Act. Any provision in a labor contract between a worker subject to the minimum wage and an employer that sets an amount less than the minimum wage amount as wages is invalid, and in such case, the invalidated portion is deemed to stipulate payment of wages equal to the minimum wage amount as prescribed by this Act. However, persons with severe intellectual disabilities or physical disabilities whose work ability is significantly low, or others deemed inappropriate for application of the minimum wage, are excluded from the application of the minimum wage.
