Among disciplinary actions, it is the one with the strongest punitive effect as a sanction, which is the employer's unilateral expression of intent that extinguishes the employment relationship. Even in cases of dismissal corresponding to a disciplinary reason, if there is no 'just cause' as prescribed in Article 30, Paragraph 1 of the Labor Standards Act, such dismissal is invalid. In other words, the disciplinary reason itself must constitute a 'just cause' to become a valid ground for dismissal.
