Relationship Between Auto Insurance and Workers' Compensation?

Most workers frequently use vehicles for commuting to and from work, visiting clients, or going on business trips, and accordingly, traffic accidents occur frequently. A traffic accident can be recognized as a work-related injury if it occurs while the worker is performing job duties. In such cases, the worker faces compensation issues from both auto insurance and workers' compensation insurance, and whether to receive payment from one or the other first is up to the individual's choice. However, under the principle of prohibition of double payment, the worker cannot receive both auto insurance and workers' compensation for the same reason. If auto insurance benefits or a civil settlement is paid first, the workers' compensation amount will be deducted by the amount of the insurance benefits or settlement already paid. However, if the auto insurance benefits are paid from a policy subscribed by the worker themselves, workers' compensation can be received in full regardless.
