What is Nursing Care Compensation?

It refers to the employer providing necessary nursing care or bearing the necessary nursing care costs when a worker suffers an injury or illness due to work (Labor Standards Act, Article 81). Nursing care compensation must be provided at least once a month, and the scope of nursing care shall include appropriate items for nursing care, such as examinations, medications or treatment materials and assistive devices, other prosthetics, treatments, surgeries and other therapies, hospitalization in hospitals or clinics, nursing care, and transportation (Enforcement Decree of the same Act, Article 42). However, if the injury or illness is not completely cured even after 2 years from the start of nursing care, a one-time compensation equivalent to 1,340 days of average wages may be provided to be exempt from all subsequent compensation liabilities under this Act (same Act, Article 87). However, even if a one-time compensation is provided under the provisions of the same paragraph, civil liability for damages or liability for consolation money payment is not automatically exempted.
