What is Annual Paid Leave?

A vacation granted to workers who have attended work at a certain rate or more for one year, exempting them from work obligations for a certain period to relieve physical and mental fatigue, maintain health, and allow workers to enjoy leisure time for social and cultural civic life. The Labor Standards Act regulates annual leave in Article 59 and enforces compliance with penalty provisions. Employers must provide 15 days of paid leave to workers who have attended 80% or more over one year, and for workers with less than one year of continuous service, 1 day of paid leave for each month of perfect attendance. When providing paid leave for a worker's first year of service, the employer includes 1 day of annual leave for each month of perfect attendance, totaling 15 days, and if the worker has used annual leave accrued for perfect attendance each month, deducts those used days from the 15 days. For workers with 3 or more years of continuous service, the employer must provide paid leave by adding 1 day for every 2 years of continuous service exceeding the first year to the number of annual leave days accrued due to 80% or more attendance each year. In this case, the total number of vacation days including the additional leave is limited to 25 days. For the purpose of calculating attendance rate for annual leave, periods of leave due to work-related injuries or illnesses and prenatal/postnatal leave periods are considered as attendance. Employers must grant annual leave at the time requested by the worker and pay ordinary wages or average wages as prescribed by employment rules or other regulations for that period. However, if granting leave at the requested time would cause significant disruption to business operations, the timing may be changed (Article 59, Paragraph 5).
