The right to association, the right to collective bargaining, and the right to collective action. Also known as the three worker rights. These are fundamental rights guaranteed by the Constitution to improve workers' rights and interests and working conditions, belonging to the right to livelihood (right to survival or social rights). Article 33 of the Korean Constitution guarantees the three labor rights, but the exercise of the right to collective action is guaranteed only within the scope prescribed by law. For workers who are public officials, the three labor rights are not recognized except for those approved by law (e.g., public officials engaged in simple manual labor, etc.), and the right to collective action of workers employed by the state, local governments, national and public enterprises, defense industries, public interest enterprises, or enterprises that have a significant impact on the national economy may be restricted or not recognized as prescribed by law.
