What is the Act on the Protection of Fixed-Term and Part-Time Workers?

As the number of non-regular workers such as fixed-term workers and part-time workers has rapidly increased, and discriminatory treatment and abusive practices against these workers have emerged as social issues, this Act was enacted to correct unreasonable discrimination against fixed-term and part-time workers, regulate abusive practices by employers, thereby protect the working conditions of these workers and promote the sound development of the labor market.
The main contents stipulate the maximum employment period for fixed-term workers as 2 years, and if employed beyond that period, they are deemed to be workers with indefinite-term employment contracts.
In addition, considering that part-time work is often performed due to workers' circumstances such as housework or studies, when requiring part-time workers to work beyond the prescribed working hours, the consent of the relevant part-time worker must be obtained, and the upper limit is set at 12 hours per week.
Furthermore, a prohibition of discrimination and correction system for fixed-term and part-time workers has been introduced to prohibit discriminatory treatment against fixed-term and part-time workers without reasonable grounds, allow fixed-term and part-time workers who have received discriminatory treatment to seek correction through the Labor Relations Commission, and place the burden of proof in disputes related to correction requests for discriminatory treatment on the employer.
