What is Labor Dispatching?

It refers to a situation where the dispatching employer hires workers and, while maintaining that employment relationship, the workers engage in labor for the user employer under the direction and commands of the user employer, in accordance with the content of the labor dispatch contract. Subcontracting involves one party setting a task completion and paying remuneration based on the results achieved. The Ministry of Employment and Labor distinguishes subcontracting if there is business independence, and dispatching if there is no independence. The tasks eligible for regular labor dispatching are 32 types of tasks requiring specialized knowledge, skills, or experience, which can be dispatched for up to 2 years. The main tasks include secretaries, typists and related office workers, telephone salespersons, collectors and related workers, artists, entertainers and sports professionals, automobile drivers, etc. However, excluding the 32 tasks and prohibited dispatch tasks (tasks at construction sites, loading/unloading tasks at ports and railways, etc., seafarer tasks, hazardous and dangerous tasks, etc.), temporary or intermittent tasks can be dispatched for up to 6 months.
