A legal relationship between an employee and an employer established by a contract under which the employee provides labor to the employer and the employer pays wages or other remuneration in return (refer to Articles 17 and 18 of the Labor Standards Act). Therefore, while an employment relationship falls under the category of an employment relationship in the Civil Act as a type of contractual relationship, it is considered a special legal relationship in that it is subject to the Labor Standards Act for the protection of employees and other laws that restrict freedom of contract.
