What is the Employment Permit System?

A foreign workforce introduction policy where the government (Minister of Employment and Labor) reviews the validity of job types and purposes presented by businesses intending to hire foreign workers and decides whether to grant permission. It is implemented in most European countries and the United States, and in our country, it has been in effect since August 2004. Users who have received employment permits can recruit directly from abroad or through public institutions or non-profit corporations designated by presidential decree, and foreign workers must go through national institutions of the sending country or institutions recognized by that country.


The user enters into an employment contract with a foreign worker who has received a work permit for a period within one year. When concluding the contract, it includes matters related to working conditions such as wages, working hours, holidays, vacations, and prohibitions on family accompaniment for cohabitation.


This system allows businesses to exercise permitting authority, enabling preemptive control over excess demand for foreign workers. Businesses can only hire foreign workers after proving they cannot hire domestic workers, thereby ensuring employment opportunities for domestic workers and preventing deterioration of working conditions due to the employment of foreign workers.


Additionally, when granting employment permission, it is possible to verify whether the business can comply with working conditions, thereby blocking unqualified businesses from hiring foreign workers in advance and faithfully protecting the rights and interests of foreign workers.
