①You can demand the employer to correct the discrimination. When an employer receives a complaint from a worker regarding recruitment and hiring, wages and other working conditions, implementation of parental leave, etc., the employer must make efforts for autonomous resolution, such as establishing and handling a grievance processing body with up to 10 representatives each from labor and management. The grievance processing body must include a representative from female workers.
②You can apply for mediation to the Employment Equality Commission. The Employment Equality Commission is established in regional labor offices (6 locations) and consists of representatives from labor, management, and public interest. The Employment Equality Commission investigates the application case, prepares a mediation proposal within 30 days, recommends acceptance to both parties, and the content of the accepted mediation document takes precedence over other working conditions.
③You can submit a petition to the regional labor office or file a complaint or report against the employer.
④You can apply for remedy for unfair dismissal to the regional labor relations commission. In cases of discriminatory treatment regarding retirement age or dismissal leading to retirement or dismissal, you can claim the unfairness of the dismissal and request reinstatement to the original position. The regional labor relations commission reviews the case, and if it is not recognized as justified, it issues a remedy order such as reinstatement, which the employer must comply with.
⑤You can file a civil lawsuit. Depending on the type of discrimination, you can claim appropriate remedies such as damages, reinstatement, payment of wage differences, etc., and unlike other civil lawsuits, the employer must prove that it was not unfavorable discrimination.
