What is Nursing Care Benefit?

A benefit under the Industrial Accident Compensation Insurance Act paid to a person who has received nursing care benefits due to a work-related injury and, after the end of nursing care, medically requires constant or occasional nursing care and actually receives it. Previously, nursing care fees were paid only during the nursing care period, so even after the illness was cured, if continuous nursing care was actually needed, the burden on the work-injured worker increased, leading to phenomena such as applying for unnecessary re-nursing care or avoiding the end of nursing care. Accordingly, with the amendment of the Industrial Accident Insurance Act on December 31, 1999, the nursing care benefit system was introduced to protect severely disabled persons by paying nursing care fees as insurance benefits when nursing care is actually provided for cases where, even after nursing care ends, among those with severe disabilities of grade 1-2, nursing care is constantly or occasionally needed due to the nature of the disease. If the recipient of nursing care benefits is admitted to a free nursing facility or the like and does not incur nursing care costs or the incurred costs are clearly less than the nursing care benefit amount, the nursing care benefit is not paid or only the actually incurred nursing care costs are paid. In addition, the nursing care benefit applies from those who were receiving nursing care at the time of enforcement of the law, so it applies from those receiving nursing care as of July 1, 2000. That is, even if nursing care ended before July 1, 2000, and severe disability remains requiring nursing care, the nursing care benefit cannot be received. The nursing care benefit is paid on a monthly basis for the days when nursing care is actually provided, and the nursing care benefit payment standards applied from September 1, 2004, are 34,977 won for constant nursing care benefit (per day) and 23,318 won for occasional nursing care benefit. ▶Article 42-3 of the Industrial Accident Compensation Insurance Act [Nursing Care Benefit] ① The nursing care benefit is paid to a person who has received nursing care benefits under Article 40 and, after recovery, medically requires constant or occasional nursing care and actually receives it. ② Necessary matters regarding the standards and methods for payment of nursing care benefits under paragraph (1) shall be prescribed by Presidential Decree.
