What is additional vacation?

Employers must provide 15 days of annual paid leave to workers who have worked more than 80% of the time in a year, and for workers who have worked continuously for more than 3 years, 1 day of leave must be added to the basic 15 days of leave for every two years of continuous employment exceeding the first year, which is called additional leave. However, the total number of annual paid leave days, including additional leave, cannot exceed 25 days. However, in the case of workplaces where the introduction of the 40-hour workweek is not mandatory according to the revised Labor Standards Act, annual paid leave of 10 days per year of perfect attendance and 8 days of annual paid leave per year of attendance of 90% or more is provided, and if the employee continues to work for more than 2 years, 1 day of leave is added for each year of continuous employment. In addition, there is no limit to annual paid leave, but if the total number of days of leave exceeds 20 days, the employer may pay ordinary wages for the excess days and may not grant paid leave.

* Prior to the amendment, under the additional leave system (Article 59, Paragraph 2 of the Employment Act), employers may provide for one year of continuous employment exceeding one year for workers who have worked continuously for two years or more. Paid leave with one day added to the leave in Paragraph 1 must be granted. However, if the total number of days of leave exceeds 20 days, regular wages may be paid for the excess days and paid leave may not be granted. *Additional vacation system after revision (Article 59, Paragraph 4 of the Employment and Labor Act) Employers must grant paid vacation to workers who have worked continuously for more than 3 years by adding 1 day for every 2 years of continuous employment beyond the first year to the vacation provided in Paragraph 1. In this case, the total number of vacation days, including additional vacation days, is limited to 25 days.
